Mexico port has claimed for pre-existing damage, says correspondent

Britannia Club’s correspondent, P&I Services Mexico, has advised that in recent weeks it has seen attempted claims by the Veracruz Port Administrators (ASIPONA) to claim damages to fenders (in “public berths”) with pre-existing damages and deteriorated conditions.

While the claims have not materialized, Port Agents have reported that Port Administrators would be delaying the relevant vessels until security was received for the alleged damages.

In order to avoid delays and unnecessary complications to vessels and their Underwriters, crews were advised to :

  • Take photos of the fender conditions in so far as possible prior to/during berthing.
  • If possible, request Port Agents to confirm the conditions of the fenders in order to best protect interests.
  • If an alleged claim is presented, contact the correspondent immediately for prompt attention.
